IMPORTANT NOTICE: BY USING THE FRONTLINE REAL ESTATE SERVICES LTD. WEBSITE (OR ANY PART THEREOF), THE USERS CONFIRM THAT THEY HAVE READ, UNDERSTOOD AND AGREED TO THE TERMS AND CONDITIONS SET OUT IN THESE TERMS OF USE, WHICH MAY BE AMENDED FROM TIME TO TIME.

1.0 ACCEPTANCE OF TERMS AND CONDITIONS

1.1 Frontline Real Estate Services Ltd., and its subsidiaries, related or affiliated corporate entities, or its agents, (collectively, “Frontline”) is committed to the delivery of excellent customer service, including services provided through Frontline’s website located at https://flre.ca/ or any component thereof, and its content materials (collectively, the “Frontline Website”). These Terms of Use will govern the terms and conditions of the use and access to the Frontline Website by the users of the Frontline Website (individually, the “User”, or collectively, the “Users”). Frontline is entitled to amend, revise, modify, or replace in its entirety, the terms and conditions of these Terms of Use, at the sole discretion of Frontline, without prior notice to the Users.

1.2 Frontline is committed to ensuring the security and integrity of the Frontline Website. Any time the Users provide their personal information to Frontline, the Users’ personal information will be collected, used, retained and/or protected in accordance with the terms and conditions of the Privacy Policy of Frontline.

1.3 By using or continuing to use the Frontline Website, the User confirms acceptance of and is deemed to have accepted the terms and conditions of these Terms of Use, as may be amended from time to time by Frontline. If a User does not agree to the terms and conditions of these Terms of Use, as amended from time to time by Frontline, the User must refrain from using the Frontline Website.

2.0 COOKIES & TRACKING TECHNOLOGY

2.1 The Frontline Website uses cookies and tracking technology in connection with the Frontline Website, depending on the features offered to and used by the Users. By using the Frontline Website, the User consents to Frontline’s use of cookies and tracking technology and consents to Frontline gathering, collecting and/or receiving tracking information related to the User, including information about the User’s browser type, operating system, the number of Users, information used to customize the Users’ experience, and information used to understand how Users use the Frontline Website (collectively, the “Tracking Information”).

2.2 By using the Frontline Website, the User consents to Frontline using Tracking Information in aggregate form and providing, sharing and/or disclosing the Tracking Information in aggregate form with and to related and unrelated third parties.

2.3 The User may to withdraw his/her consent for Frontline to use the Tracking information by refusing the use of cookies when using the Frontline Website. However, if the User refuses to use cookies, the User may not be able to access or use the Frontline Website or access or services that may be provided to Users through the Frontline Website.

3.0 LIMITED LICENSE TO USE & USER REPRESENTATIONS

3.1 Any and all intellectual property rights associated with the Frontline Website are the sole and exclusive property of Frontline. The Frontline Website is protected by copyright and other laws in Canada and other locations and may not be copied, imitated, or sold, in whole or in part, unless it is with the express written consent of Frontline

3.2 Frontline grants to the Users a limited and personal right to access and use the Frontline Website, on terms and conditions set out in these Terms of Use, or as may otherwise be expressly presented to the Users.

3.3 In accessing and using the Frontline Website, the Users agree to each of the following:

a) the User will not hide the origin of information transmitted through the Frontline Website;
b) the User will not provide to Frontline any false or misleading information through the Frontline Website;
c) the User will not access or use the Frontline Website, or any of the services accessible through the Frontline Website for any purpose unless permitted under the policies implemented by Frontline;
d) the User will not access or use the Frontline Website, or any of the services accessible through the Frontline Website for any purpose contrary the laws of Canada and the laws applicable to the User; and
e) the User will not do anything that will or is intended to damage, interfere, interrupt, harm or otherwise negatively affects the Frontline Website in any way.

3.4 By accessing and using the Frontline Website, the User represents and warrants to Frontline that the User is not in a location whereby the User’s access and use of the Frontline Website and access and use of the services provided through the Frontline Website is contrary to the laws of Canada and the laws that are applicable to the User.

4.0 CHANGES & MODIFICATIONS TO FRONTLINE WEBSITE

4.1 Frontline is entitled to change, modify, or replace the Frontline Website, at any time at its sole discretion without prior notice to the Users, including without limitation, changes to services offered through the Frontline Website.

4.2 Frontline expressly reserves the right to change, modify, replace, suspend, interrupt, delete, or terminate the operation of or access to the Frontline Website, at the sole discretion of Frontline, at any time for any reason whatsoever, without notice to the Users, including without limitation reserving the right to do any of the following:

a) change or impose fees for services provided through the Frontline Website at any time in its sole discretion, including changes to existing fee structure for services offered through the Frontline Website;
b) change or impose general practices and limitations concerning the Frontline Website at any time in its sole discretion; and
c) modify access to the Frontline Website as necessary to perform routine or non-routine maintenance.

5.0 LIMITATION OF LIABILITY & WAIVERS

5.1 The User acknowledges that the information provided on the Frontline Website is provided to the Users on an “as is where is” basis and may contain errors, mistakes, or out-of-date information with respect to the services offered by Frontline. The User expressly accepts that the use of the Frontline Website is accessed and used at the User’s own risk.

5.2 The information provided through the Frontline Website was obtained from sources which we deem reliable and while thought to be correct is not guaranteed by Frontline and Frontline makes no representations or warranties about the results to be obtained from the use of the services provided through the Frontline Website. Without limiting the generality of the foregoing, Frontline does not guarantee or warrant the accuracy, completeness, quality, or currency of the information provided through the Frontline Website, to the fullest extent permitted by applicable law.

5.3 The Frontline Website may contain links to third-party websites and resources (collectively, “External Links”). These External Links are provided solely as a convenience to the Users only and is not endorsed by Frontline. The information provided External Links is not guaranteed by Frontline. Without limiting the generality of the foregoing, Frontline does not guarantee or warrant the accuracy, completeness, quality, or currency of the information provided through External Links. The Users access and use of External Links will be accessed and/or used at the Users’ own risk.

5.4 The User agrees that Frontline will not be liable for and irrevocably and unconditionally waives, releases and forever discharges Frontline, and its officers, directors, servants, employees, agents, and each of their heirs, executors, administrators, successors and assigns, of and from any and all actions, causes of actions, claims, debts, demands and damages howsoever arising which the User now have or can, shall or may have for in the future by reason of or arising out, or in connection with the User’s access or use of the Frontline Website, including without limitation, claims for direct, indirect, or consequential damages, special damages, damages arising from loss of profit or business interruption, and any other claims whether made in law or in equity.

6.0 TERMINATION

6.1 Notwithstanding any other term or condition in these Terms of Use to the contrary, Frontline reserves the right to revoke, suspend, terminate or otherwise restrict the Users’ access and use of the Frontline Website, at any time for any reason, at the sole discretion of Frontline, even if access and use by other Users are not revoked, suspended, terminated, or otherwise restricted.

6.2 The User expressly agrees that Frontline will not be liable to the User or any other party, in respect of any matter arising from Frontline’s revocation, suspension, termination or otherwise restriction of the User’s access and/or use of the Frontline Website, the services provided through the Frontline Website.

7.0 GENERAL PROVISIONS

7.1 Frontline will not be liable for any delay in performing any of its obligations under these Terms of Use if such delay is caused by circumstances beyond the reasonable control of Frontline and Frontline will be entitled to a reasonable extension of time for the performance of such obligations.

7.2 Frontline’s failure to insist on or delay in enforcing strict performance of these Terms of Use shall not be construed as a waiver by Frontline of any provision or any right it has to enforce these Terms of Use, nor shall any course of conduct between Frontline and the User or any other party be deemed to modify an provision of these Terms of Use, unless it is in accordance the provisions set out in these Terms of Use.

7.3 All provisions of these Terms of Use are to be construed as separate and distinct covenants and agreements, separable from all other separate and distinct covenants and agreements. If any term or condition of these Terms of Use is determined to be illegal, void or unenforceable, it and they will be considered separate and severable from these Terms of Use and its remaining provision will remain enforced and be binding upon the User.

7.4 These Terms of Use constitute the entire agreement between Frontline and the Users with respect to the subject matter of these Terms of Use, and supersedes all prior negotiations, promises, representations and agreements, both written and oral, between Frontline and the Users. Any modification of these Terms of Use is void and unenforceable, unless it is in writing, and signed by an authorized signatory of Frontline, and delivered to all parties.

7.5 These Terms of Use will be governed by and interpreted in accordance with the laws of the Province of British Columbia and the laws of Canada. The User hereby consents and submits to the exclusive jurisdiction of the courts of the Province of British Columbia in any action or proceedings related to the User’s access to and use of the Frontline Website under these Terms of Use.
